    SB 0143 - I am Jon Bartlett. You may remember me from working together at West Jordan City. I am concerned about the above referenced Senate Bill that changes the foreclosure law. This bill amends Representative LaVar Christensen’s foreclosure bill HB0164 that requires that the lender give delinquent borrowers a Single Point of Contact before foreclosing. Representative Christensen’s bill had an unintended consequence of nearly completely stopping foreclosures in their tracks for several months as lenders tried to figure out what it meant and how to deal with it. The bill was very disruptive to business. National Lenders have been enduring a less favorable public opinion lately and have been bending over backwards to try to be fair to delinquent borrowers. They are very skittish of any new regulation. We believe that the above bill, while trying to help the disruption of last year’s bill, will have the same or worse disruptive effect the last years bill had. We are particularly concerned about: (a) require that the SPOC have the authority to make decisions on foreclosure relief applied for by the borrower and (b) remove entirely subsection 14 from the current 57-1-24.3.

    I urge you to oppose SB0143. The entire Real Estate community would be greatly appreciated.
