Violations of the act are considered an unlawful merchandising practice, which the Attorney General currently has authority to prosecute. This act is similar to HB 1796 (2008). Any person using a wireless telephone for emergency purposes; an emergency services professional using a wireless telephone in the scope of his or her duties; or a person using a digital two-way radio and is driving a commercial vehicle, excluding pick-up trucks, wreckers, or tow trucks are exempt from the provisions of the act. The provisions of the act do not apply to any person operating a motor vehicle on private property. Any violation will be an infraction punishable by a $20 fine for a first offense and a $50 fine for a second or subsequent offense. This act is substantially similar to SB 664 (2007).
