DPH-NEONATAL DIABETES REGISTRY Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to develop and implement a neonatal diabetes mellitus registry pilot program. Requires the Department to create an electronic registry to track glycosylated hemoglobin levels of persons. Requires physicians and other healthcare providers treating a patient with diabetes mellitus with onset before 12 months of age to report the occurrence of all such cases to the Department. Requires clinical laboratories performing glycosylated hemoglobin tests for patients with diabetes mellitus with onset before 12 months of age to report the results of each test that the laboratory performs to the Department. Provides that the Department shall allow access of the registry to neonatal diabetes mellitus research institutions. Provides that these provisions are repealed on December 31, 2011. DAY TEMP LABOR-LOCATION-SCHOOL

Amends the Day and Temporary Labor Services Act. Provides that, in a municipality with more than 1,000,000 inhabitants, a day and temporary labor service agency may not operate or transact business at a location that is within 1,000 feet of a school building or a building in which a Boys and Girls Club is located or real property comprising a school or a Boys and Girls Club. Exempts a day and temporary labor service agency that registered with the Department of Labor before January 1, 2008 and received an occupancy permit from the municipality for that location before January 1, 2008. Defines "school" as a public or private pre-school, elementary school, or secondary school. Contains a home rule preemption.

ICC-LABOR WAGES-CERTIFICATE

Amends the Common Carrier by Pipeline Law in the Public Utilities Act. Provides that no certificate of good standing issued by the Illinois Commerce Commission shall be valid unless the common carrier by pipeline provides all employees a wage of no less than the general prevailing hourly rate as paid for work of a similar character in the locality in which the work is performed as prescribed by the Prevailing Wage Act. Provides that the Commission may require the Illinois Department of Labor to certify a common carrier by pipeline's compliance with specified provisions. Provides that the Commission may reinstate a certificate in good standing to a common carrier by pipeline upon receiving reasonable evidence that the common carrier by pipeline has complied with specified provisions. With respect to employees hired on or after the effective date of the Act, prohibits an employer from having a criminal history records check performed on an employee for one year after he or she has been hired. Provides that this prohibition does not prohibit an employer from having a criminal history records check performed on an applicant for employment. Provides that, if a criminal background check is relevant to the decision to hire or retain an employee, the application must clearly state that the criminal background check will impact the decision to hire or retain the employee. Amends the Illinois Educational Labor Relations Act. With respect to the Illinois Educational Labor Relations Board designating an exclusive representative for purposes of collective bargaining, provides that if either party provides to the Board, before the designation of a representative, clear and convincing evidence that the dues deduction authorizations or other evidence (instead of dues deduction authorizations and other evidence) upon which the Board would otherwise rely to ascertain the employees' choice of representative are fraudulent or were obtained through coercion, the Board shall promptly thereafter conduct an election.

CLEAN CAR ACT Creates the Illinois Clean Car Act. Provides that the Environmental Protection Agency shall propose and the Pollution Control Board shall establish by rule a Clean Car Program that is (i) authorized by Section 177 of the federal Clean Car Act, and (ii) applicable to vehicles of the 2012 model year and every subsequent model year. Provides that the Agency shall establish new motor vehicle emission standards and compliance requirements for vehicles under the Program. Provides that the Agency may work in collaboration with other states in developing the Program. CRIME LAB ANALYSIS FEES Amends the Unified Code of Corrections with respect to crime laboratory analysis fees. In the definition of "crime laboratory", provides that it must be formally accredited and must regularly employ persons who conduct analyses and provide testimony with respect to drug identification, latent fingerprint analysis, and DNA analysis. Enumerates additional offenses for which a guilty offender must pay a fee and increases those fees to varied amounts depending on the offense. Provides that laboratories using a crime laboratory fund must have and file documented procedures and policies concerning its response to discoveries of misconduct or incompetence and claims of innocence by convicted prisoners. Makes other changes. Adds a new Section providing that: members and representatives of a recognized union within the State of Illinois may pass handbills on the property of retail stores; members and representatives of a recognized union within the State of Illinois may pass handbills in parking lots and outside entryways of retail stores, as long as they are not within 15 feet of the entrance of a retail store; and the new Section does not allow union members to pass handbills inside a retail store.

PHOSPHOROUS TURF FERT USE ACT Creates the Phosphorous Turf Fertilizer Use Restriction Act. Provides that, beginning July 1, 2009, a person may not apply a fertilizer containing the plant nutrient phosphorus to turf in this State. Provides that the restriction does not apply when (i) a tissue, soil, or other test by a laboratory or method approved by the Agency and performed within the immediately preceding 3 years indicates that the level of available phosphorus in the soil is insufficient to support healthy turf growth or (ii) the property owner or an agent of the property owner is first establishing turf via seed or sod procedures, but only during the first growing season. Sets a maximum fine for violation of the restriction. Provides that the University of Illinois Extension Service, in cooperation with the Environmental Protection Agency, shall study and evaluate phosphorus needs of turf throughout the State and develop the standard for the minimum amount of available phosphorus [...]

Amends the Chicago Laborers Article of the Illinois Pension Code. Amends a Section of the Environmental Protection Act involving Petroleum Underground Storage Tanks. Provides that site investigation completion reports must be made available, upon request, to any person with an ownership interest in a remediation site or the property on which the remediation site is located. Makes changes to the remediation process, including requiring public hearings, when remediation objectives have not been achieved within the specified time period. Provides that if all applicable remediation objectives have not been achieved at a site within 10 years after completion of the site investigation, the Agency, in collaboration with the Board, must hold a public hearing to determine whether the responsible owner or operator will either (i) pay the Agency to conduct the proper corrective action or (ii) purchase the site from the current site owner for the site's fair market value.
