DPH-NEONATAL DIABETES REGISTRY Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to develop and implement a neonatal diabetes mellitus registry pilot program. Requires the Department to create an electronic registry to track glycosylated hemoglobin levels of persons. Requires physicians and other healthcare providers treating a patient with diabetes mellitus with onset before 12 months of age to report the occurrence of all such cases to the Department. Requires clinical laboratories performing glycosylated hemoglobin tests for patients with diabetes mellitus with onset before 12 months of age to report the results of each test that the laboratory performs to the Department. Provides that the Department shall allow access of the registry to neonatal diabetes mellitus research institutions. Provides that these provisions are repealed on December 31, 2011. LONG TERM CARE FACILITIES INFO Amends the Illinois Act on the Aging, the Assisted Living and Shared Housing Act, the Nursing Home Care Act, the Illinois Public Aid Code, and the Consumer Fraud and Deceptive Business Practices Act. Requires that each licensed long term care facility, assisted living or shared housing establishment, and supportive living facility complete and file with the Office of State Long Term Care Ombudsman a Consumer Choice Information Report on a form developed by the Office with the collaboration of the Attorney General. Specifies the contents of the Report. Requires that an initial Report be filed by July 1, 2009. Requires that subsequent Reports be filed at least annually and that verification of completion and filing must be included in the facility’s or establishment’s inspection. MINORITY MENTAL HLTH AWARENESS Amends the Department of Human Services Act. Requires the Department to include mental health awareness, education, and outreach materials within its public health promotion programs and information to be directed toward minority population groups in Illinois. Provides that this information shall inform members of minority communities about mental illness, the types of services and supports available, and how treatment may be obtained. PEN CD-CHIC MUNI-DUTY DISABLTY Amends the Chicago Municipal Article of the Illinois Pension Code. Provides that, before any action is taken by the Board on an application for a duty disability benefit or a widow's compensation or supplemental benefit, the employee or widow shall file a claim with the employer to establish that the disability or death occurred while the employee was acting within the scope of and in the course of his or her duties. Provides an offset of disability benefits for any amounts provided to the employee or surviving spouse as temporary total disability payments, permanent disability payments, a lump sum settlement award, or other payment under the Workers' Compensation Act or the Workers' Occupational Diseases Act. PENSION-CHI LABOR-DISAB OFFSET Amends the Chicago Laborers Article of the Illinois Pension Code. With respect to certain duty and ordinary disability benefits and widow's compensation and supplemental benefits payable by the Fund, replaces existing provisions relating to the offset of amounts received under the Workers' Compensation Act or Workers' Occupational Diseases Act or related settlements with new provisions applying to those offsets and the administration, commencement, and amount of those benefits. ADMIN HEARINGS OFFICE Amends the Illinois Administrative Procedure Act to create the Office of Administrative Hearings. PENSIONS-DISCLOSURES Creates the Pension Funding and Investments Act. Requires pension plan providers to provide statements to members of a plan that include (1) the actuarial value of the assets and liabilities of the plan, (2) the extent to which the plan is funded, (3) the plan's funding policy, and (4) asset allocations based on the percentage of overall plan assets. Provides that, if a request is made by a contributing employer or labor organization, then a pension plan provider must make available (1) copies of all actuary reports received by the pension plan provider for a plan year and (2) copies of all financial reports prepared by fiduciaries of the pension plan provider. STATE FACILITY OVERTIME ACT Creates the State Facility Overtime Act. Provides that the Director of the State agency responsible for the operation of specified State facilities (or the Director's designee or agent) may not require an employee to accept work in excess of an agreed upon, predetermined, and regularly scheduled daily work shift, not to exceed 40 hours per week. Provides for: exceptions to the prohibition; posting a summary of the Act and applicable rules; investigation of complaints by the Illinois Department of Labor and disposition of complaints; adoption of administrative rules; construction; and other matters. PUBLIC AID-CHILD CARE PROVIDER Amends the Illinois Public Aid Code. Provides that as a condition of eligibility to participate in the child care assistance program, a child care provider must authorize in writing an investigation to determine whether the child care provider has ever been charged with a crime and, if so, the disposition of those charges. Provides for confidentiality of information received by the Department of Human Services. ALL KIDS-APPLICATION AGENTS Amends the Covering ALL KIDS Health Insurance Act. Provides that the Department of Healthcare and Family Services shall develop procedures to train application agents. Also provides that the Department shall provide to private employers, including private employers regulated under the Day and Temporary Labor Services Act, a grant of $50 for each person that the private employer enrolls in the Covering ALL KIDS Health Insurance Program. NEW EMPLOYEE-CRIM BACKGRND CK Creates the New Employee Criminal History Records Check Act. With respect to employees hired on or after the effective date of the Act, prohibits an employer from having a criminal history records check performed on an employee for one year after he or she has been hired. Provides that this prohibition does not prohibit an employer from having a criminal history records check performed on an applicant for employment. Provides that, if a criminal background check is relevant to the decision to hire or retain an employee, the application must clearly state that the criminal background check will impact the decision to hire or retain the employee. CLEAN CAR ACT Creates the Illinois Clean Car Act. Provides that the Environmental Protection Agency shall propose and the Pollution Control Board shall establish by rule a Clean Car Program that is (i) authorized by Section 177 of the federal Clean Car Act, and (ii) applicable to vehicles of the 2012 model year and every subsequent model year. Provides that the Agency shall establish new motor vehicle emission standards and compliance requirements for vehicles under the Program. Provides that the Agency may work in collaboration with other states in developing the Program. CRIME LAB ANALYSIS FEES Amends the Unified Code of Corrections with respect to crime laboratory analysis fees. In the definition of "crime laboratory", provides that it must be formally accredited and must regularly employ persons who conduct analyses and provide testimony with respect to drug identification, latent fingerprint analysis, and DNA analysis. Enumerates additional offenses for which a guilty offender must pay a fee and increases those fees to varied amounts depending on the offense. Provides that laboratories using a crime laboratory fund must have and file documented procedures and policies concerning its response to discoveries of misconduct or incompetence and claims of innocence by convicted prisoners. Makes other changes. PHOSPHOROUS TURF FERT USE ACT Creates the Phosphorous Turf Fertilizer Use Restriction Act. Provides that, beginning July 1, 2009, a person may not apply a fertilizer containing the plant nutrient phosphorus to turf in this State. Provides that the restriction does not apply when (i) a tissue, soil, or other test by a laboratory or method approved by the Agency and performed within the immediately preceding 3 years indicates that the level of available phosphorus in the soil is insufficient to support healthy turf growth or (ii) the property owner or an agent of the property owner is first establishing turf via seed or sod procedures, but only during the first growing season. Sets a maximum fine for violation of the restriction. RAILROAD POLICE-MISCONDUCT Amends the Railroad Police Act. Requires allegations of abuse of authority or misconduct by members of a railroad police force to be investigated by the Illinois State Police. Amends the Illinois Vehicle Code. Exempts elected representatives of rail carriers from the restrictions concerning trespassing on railroad property. Creates the Committee as an interagency advisory committee to develop a comprehensive statute to implement the Model Interstate Compact on Military Families.
