MOBILE HOME PARK FIRE SAFETY Amends the Mobile Home Park Act. Provides that the agreement required in the case of a mobile home park that does not have a private water supply system and hydrants must be signed and dated by the owner of the mobile home park or his or her representative and by the local fire chief or his or her representative and must be submitted with each application for an original license or license renewal application under the Act. Provides that a mobile home park constructed after January 1, 1998 must be located in an area protected by a fire department or fire protection district and provided with fire hydrants within 500 feet of any structure in the mobile home park. Provides that as an alternative to fire hydrants, a holding pond or other source of water of 100,000 gallons or more accessible to the fire department or fire protection district may be used, if the fire department or fire protection district is capable of pumping from the body of water. MUNI TIF-FIRE PROTECTION Amends the Tax Increment Allocation Redevelopment Act in the Illinois Municipal Code. In the definition of "redevelopment project costs", includes a fire protection district's increased costs attributable to the redevelopment project area. UTILITIES-FIRE HYDRANT REPAIR Amends the Public Utilities Act. Provides that a water utility official or his or her designee must notify (i) the local fire officials of any hydrant that it finds necessary to take out of service for water main-related work due to emergency repairs or scheduled maintenance, whenever such maintenance work and hydrant out of service condition is expected to last more than 8 hours or if the main will be unattended at any time during the outage and (ii) the dispatcher or designated fire official of any hydrant reported to be inoperable or expected to operate with a rate of water flow less than a normal rate expected for the hydrant as soon as practical, but in no event more than 2 hours, after receiving the notice from an employee, contractor, police department, or other government official, and, under normal conditions, must have the hydrant restored to service within 48 hours. PEN CD-ART 4-MILITARY SERVICE Amends the Downstate Firefighter Article of the Illinois Pension Code. Provides that the governing body of a municipality may elect to allow creditable service for up to 24 months of military service served prior to employment by a municipality, but no credible service shall be allowed for such person for any period that can be used in the computation of a pension or any other pay or benefit, other than pay for active duty. Requires contributions to the fund equal to (i) the employee contributions that would have been required had the service been rendered as a member, plus (ii) an amount determined by the fund to be equal to the employer's normal cost of the benefits accrued for that military service, plus (iii) interest. Provides that the changes apply only to participating employees in service on or after the effective date of the amendatory Act. Provides that a fire department foreign fire insurance board in a municipality with fewer than 500,000 (now, 250,000) inhabitants shall have 7 trustees, including the fire chief and 6 members of the fire department (now, the Board is established by ordinances of the corporate authorities). Provides for an annual election of board officers. Provides that the annual municipal audit shall include funds appropriated to the board and shall determine whether the funds have been expended by the board only for the maintenance, use, and benefit of the department. FIRE SAFETY-IMITATE SPRINKLER Creates the Fire and Life Safety Device Act. Provides that the manufacture, installation, or sale of any device or object that reasonably appears to be a smoke detector, sprinkler head, carbon monoxide alarm, heat detector, or any other similar device used for life safety or fire protection that is, in fact, neither designed nor capable of performing such life safety or fire protection function, is prohibited. Establishes penalties for violations of the Act. Provides that inspectors employed by municipalities, fire protection districts, and counties and those individuals who meet the certification requirements of the Fire Sprinkler Contractor Licensing Act may inspect such devices to ensure compliance with the Act. FINANCE AUTHORITY-FIRE STATION Amends the Illinois Finance Authority Act. Requires the Authority and the State Fire Marshal to jointly administer a program of zero-interest loans to fire departments and fire protection districts for the construction, rehabilitation, remodeling, and expansion of fire stations and the acquisition of land for the construction and expansion of fire stations. Amends the State Finance Act. Creates the Fire Station Revolving Loan Fund as a special fund in the State treasury for purposes of the loan program. Effective July 1, 2008. DISPOSABLE LIGHTER SURCHARGE Creates the Disposable Lighter Surcharge Act. Requires each wholesaler of disposable cigarette lighters to be sold and delivered in Illinois to collect a surcharge of $0.25 per lighter and pay the collected surcharge to the Department of Revenue. Requires each wholesaler of disposable cigarette lighters to make a monthly return to the Department. Requires the Department to deposit the surcharge proceeds into the Fire Truck Revolving Loan Fund, the Ambulance Revolving Loan Fund, and the Fire Service and Small Equipment Fund. Sets forth procedures for the administration of the surcharge. Provides that any wholesaler that violates the Act is guilty of a Class 4 felony. Provides that the Act is repealed on June 30, 2013. FIRE PREVENTION SAFETY ACT Creates the Fire Prevention Safety Act. Provides that no person, being the owner, occupant, lessee, designer, or builder of any building or other structure, shall permit alteration or construction of the building or structure to violate any provision of the code adopted by the Office of the State Fire Marshal or the rules adopted under the Act. Requires the Office of the State Fire Marshal to adopt a national model fire safety code to be the minimum fire safety code in the State of Illinois and to adopt rules. Provides that the Office of the State Fire Marshal, and the officers of cities, villages, towns, and fire protection districts, shall enforce such rules, under the direction of the Office of the State Fire Marshal. FIRE SPRNKLR-DESIGN DRAWINGS Amends the Fire Sprinkler Contractor Licensing Act. Makes a change to the definition of "fire protection system layout documents". Provides that all design drawings and design specifications (design documents) of engineered sprinkler systems must be stamped by a licensed professional engineer or a licensed architect. Provides that all fire protection system layout documents and shop drawings (now, just fire protection system layout documents) of fire sprinkler systems shall be prepared based on the design documents for approval and submittal (now, there is no requirement of basis documents) by (i) a licensed professional engineer, (ii) a licensed architect, or (iii) a holder of a valid NICET level 3 or 4 certification in fire protection technology automatic sprinkler system layout who is licensed under the Act or employed by an organization licensed under the Act.
