Gambling - Provides that for a premium offered at a public fair to be lawful, its fair market value cannot exceed $25.00. - Amends TCA Title 39, Chapter 17, Part 5.

Under present law, entering and contending for any and all premiums at public fairs is not classified as gambling for purposes of criminal offenses. This bill limits the fair market value of any premium that is entered and contended for at any public fair to $25.00 in order for the exemption to apply. Under this bill, entering and contending for any premium valued at more than $25.00 at a public fair would be considered gambling, a Class C misdemeanor.

Fiscal Summary for *HB1558 / SB1993Other Fiscal Impact - If unclaimed prize money were to ever exceed the current $18.0 million limit in the future, then after-school programs would benefit by such excess amount up to $2.0 million. Any unclaimed prize money in excess of $20.0 million would accrue to the Lottery for Education Account. However, this is considered an unlikely scenario in the near future given historical trends and forecasts for unclaimed prize money for FY07-08 and FY08-09.
