Payday Loan Act; database. Requires the StateCorporation Commission, by January 1, 2009, to certify and contract with one ormore third parties to develop, implement, and maintain an Internet-accessibledatabase, and requires payday lenders to query the database prior to making anyloan to determine whether an applicant is eligible for the loan. Fifty centsmay be charged to defray the costs of using the database. The proceeds from thefees shall be used only for the payment of the expenses of the administrationof the Payday Loan Act and of the performance of other functions of the Bureauof Financial Institutions. This bill was incorporated into HB 12.

Requires the Auditor of Public Accounts to maintain on its websitean electronic copy of the current appropriations act and any amendmentsthereto, and an electronic copy of any budget bill submitted for a newbiennium, and all amendments thereto. The electronic copies shall be completelyand easily searchable by the citizens of the Commonwealth using a commercialsearch engine. This bill is incorporated into HB 1360.

Requires theDirector of the Department of Planning and Budget to maintain a searchablebudget database website that would allow persons to search and aggregateinformation for individual or specific appropriations or budget items. TheDirector would be required to have the database operational by July 1, 2009.When fully operational, all data in the database would be maintained for aminimum of 10 years. The bill would repeal a current provision that requiresthe Auditor of Public Accounts to maintain an online searchable databaseproviding certain state expenditure, revenue, and demographic information. Thisbill is incorporated into HB 1360.

Permits localities toprohibit the disposal of cathode ray tubes in any waste-to-energy or solidwaste disposal facility within its jurisdiction, provided the locality hasimplemented a recycling program that is capable of handling all cathode raytubes generated within its jurisdiction. Previously the ban only applied toprivately operated landfills.

Summary as passed House: Computer Recovery and Recycling Act; penalties.Requires the manufacturer of more than 500 items of computer equipmentto adopt and implement a recovery plan providing for the reasonablyconvenient collection, recycling, and reuse of computer equipmentreturned by a consumer in the Commonwealth. The manufacturer mustalso affix a permanent, readily visible label to the computer equipmentwith the manufacturer's brand before a manufacturer may offer computerequipment for sale in the Commonwealth. Examples of collection methodsmeeting the recovery plan requirements in this Act include (i) a systemby which the consumer may return the computer equipment free of charge;(ii) a system using a physical collection site; or (iii) a systemusing collection events at which the consumer may return computerequipment. Each manufacturer must annually report on the weight ofcomputer equipment collected, recycled, and reused during the precedingcalendar year.

Present law gives GeneralAssembly and local candidates the option to file electronically with the StateBoard. The bill applies statewide to the General Assembly candidates and to theCounties of Fairfax, Prince William, Henrico, Chesterfield, Arlington, andLoudoun and the Cities of Virginia Beach, Norfolk, Chesapeake, Richmond,Newport News, Hampton, Alexandria, and Portsmouth with respect to localcandidates.

Requires aperson or business that conducts business in Virginia and that ownsor licenses computerized data that includes personal information toconduct a reasonable investigation to promptly determine the likelihoodthat personal information has been or will be misused when it becomesaware of an incident of unauthorized access to personal customer information.Notification must be made in the most expedient time possible andwithout unreasonable delay, consistent with the legitimate needs oflaw enforcement. The bill also contains alternative notification provisions.Any customer injured by a violation of this section may institutea civil action to recover actual damages or to enjoin any businessthat violates or has violated this section.
