Claims; Sumpter and Robin Priddy. Provides relief inthe amount of $65,000 to Sumpter and Robin Priddy. Property owned by thePriddys was leased by Virginia Commonwealth University (VCU). The leaseincluded an option for VCU to purchase the property with the price to be basedon the average of two appraisals that were to be conducted at the end of thefive-year lease. The Virginia Commonwealth University Real Estate Foundation(the “Foundation), a VCU “affiliated organization,” attempted to exercise theoption based on appraisals done prior to the expiration of the lease. In asubsequent suit to enforce the option, the court held that in basing thepurchase price on appraisals that were done prior to the expiration of thelease, VCU did not properly exercise its option. The amount of the claim is toreimburse the Priddys for attorney and appraisal fees and other costsassociated with the Priddys’ defense against the lawsuit.

Moneys in the Fund shall be used for the sole purpose of attractingpublic and private research funding for institutions of higher education inorder to increase renewable energy research capacity and developmentopportunities in Virginia. Summary as passed: Covenants restricting solar energy collection devices. Providesthat a community association shall not prohibit an owner from installing orusing any solar energy collection on the owner's property; but such associationmay establish reasonable restrictions concerning the size, place, and manner ofplacement of the solar energy collection devices. The bill allows a communityassociation to prohibit or restrict the placement of such devices on the commonareas. The bill provides that nothing shall be construed to (i) invalidate anyprovision of a restrictive covenant that prohibits or restricts theinstallation or use of any solar collection device if such provision was ineffect before July 1, 2008, or (ii) prohibit the amendment of a restrictivecovenant on or after July 1, 2008, to prohibit or restrict the installation oruse of any solar collection device if such amendment is adopted by themembership of the community association in accordance with such association’sgoverning [...]
