Any person using a wireless telephone for emergency purposes; an emergency services professional using a wireless telephone in the scope of his or her duties; or a person using a digital two-way radio and is driving a commercial vehicle, excluding pick-up trucks, wreckers, or tow trucks are exempt from the provisions of the act. The provisions of the act do not apply to any person operating a motor vehicle on private property. Any violation will be an infraction punishable by a $20 fine for a first offense and a $50 fine for a second or subsequent offense. This act is substantially similar to SB 664 (2007). STEPHEN WITTE

Telephone companies or providers of telephone directories or directory assistance services are not liable for any such deceptive listing, provided the deceptive listing does not relate to their own businesses.
