MOBILE HOME LANDLORD TENANT Amends the Mobile Home Landlord and Tenant Rights Act. Provides that a park owner shall present a lease to a prospective tenant at least one day before signing the lease. Provides that when a mobile home park is owned by an entity that is publicly traded on any national stock or securities exchange, then the following conditions apply: 1) the park owner is to have a refund procedure for a lease or purchase agreement that a prospective tenant cancels within 3 days after signing the lease or purchase agreement; 2) if a tenant leaves the park because of a temporary illness or disability, the park owner shall allow qualified, including age in a park that has "housing for older persons", relatives designated by the tenant or the tenant's guardian to live in the home; 3) automatic lease renewal for 2 years unless certain requirements are met, such as a 30-day notice and a notice of reasons for the non-renewal of the lease; 4) the park owner is to give 12 [...]

PROCUREMENT DISCLOSURES Amends the Illinois Governmental Ethics Act. Requires that a special government agent file his or her statement of economic interests within 60 days after assuming responsibilities as a special government agent (now, within 30 days after making an ex parte communication). Amends the Illinois Procurement Code. Prohibits all State employees from obtaining State contracts (now, those earning more than 60% of the Governor's compensation). Requires that a waiver from the prohibition against obtaining State contracts must be filed within the earlier of 60 days after it is issued or when contract performance begins, and provides that the contract is voidable if the waiver is not filed within that period. Prohibits the State from entering into a contract with respect to the issuance of bonds or other securities with an entity that uses an independent consultant. Defines an independent consultant. Permits a State agency to renew or extend a lease of real property or capital improvements without using the request for information selection process if it is in the State's best interest and the Procurement Policy Board does not object (now, permitted only for renewal or extension of leases in effect before July 1, 2002). PEN CD-INVESTMENT LIMITATION

Amends the Illinois Pension Code. Provides that a retirement system or pension fund established under the Downstate Police, Downstate Firefighters, or Illinois Municipal Retirement Fund Article may not acquire a security issued by an employer of employees covered by any retirement system or pension fund under any of those Articles, including itself, if immediately after such acquisition, the aggregate fair market value of all such employer securities held by the retirement system or pension fund exceeds 10% of the fair market value of the assets of the retirement system or pension fund. Effective immediately.

Provides that the Treasurer shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. Effective upon being declared adopted, and applies upon conclusion of the terms of the Comptroller and Treasurer elected in 2006.

Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the Offices of the Comptroller and Treasurer. Provides instead for a single State Fiscal Officer. Provides that the State Fiscal Officer shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. Effective upon being declared adopted, with the first State Fiscal Officer elected in 2010. No Comptroller or Treasurer shall be elected after 2006.

INS-CUST AGRMTS CLRG CORP Amends the Illinois Insurance Code. Creates an Article concerning custodial agreements and the use of clearing corporations. Provides definitions. Allows domestic insurance companies to deposit securities held or purchased for its general account in a clearing corporation. Allows certificates representing securities of the same class of the same issuer to be merged and held in bulk in the name of the nominee of the clearing corporation regardless of the ownership of the securities and for certificates representing smaller denominations to be merged into one or more certificates of larger denominations. Allows ownership and other interests in securities to be transferred by bookkeeping entry without physical delivery of certificates. PEN CD-PERMITTED INVESTMENTS

Amends the Illinois Pension Code. In provisions concerning permitted investments for pension funds with net assets of $5,000,000 or more, (i) removes provisions requiring that securities are of a corporation created or existing under the laws of the United States or any state, district, or territory thereof and that the issuer of the stocks has been subject to the requirements of Section 12 of the federal Securities Exchange Act of 1934 and has been current with the filing requirements of specified Sections of that Act during the preceding 3 years and (ii) increases the maximum percentage of the market value of the pension fund's net present assets in certain investments from 35% to 50% if the fund utilizes an investment management consultant or an investment manager. Effective immediately.
