Imposes an additional tax of $0.06 cents per gallon on all motor fuel used in motor vehicles operating on the public highways, recreational type watercraft operating upon the waters, special fuel, and diesel fuel sold in this State. Provides that the proceeds of this tax must be deposited into the 8,000# Road Improvement Fund and distributed to municipalities, counties, and township road districts in the State for the purpose of improving roads and streets and of repairing damage to roads and streets caused by increased weight limits under the Illinois Vehicle Code. Amends the State Finance Act to create the 8,000# Road Improvement Fund. Amends the Illinois Highway Code. Increases, from $15,000,000 to $30,000,000, the amount appropriated for counties for the use of road districts for the construction of bridges 20 feet or more in length. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that, in each State fiscal year, the Department must use the first $2,500,000 available for use by the Department for loans and grants for railroad facilities to make grants to railroads that are registered rail carriers, other than Class 1 railroads as designated by the Federal Railroad Administration. Amends the State Finance Act to exempt the State Rail Freight Loan Repayment Fund from a provision of the Act that allows the Governor to transfer funds from certain special funds into the General Revenue Fund. Effective July 1, 2007.

Provides that the Department of Transportation shall, upon application, erect and maintain roadside markers to identify the locations where persons were killed in accidents involving drunken drivers. Establishes requirements for the application for placement of the markers and for the markers themselves. Provides that, if the new provision conflicts with federal law, the markers shall not be erected or maintained. Provides that the Department shall prepare an evaluation of the program authorized by the new provision and shall report its findings to the General Assembly by January 1, 2008. Amends the Illinois Highway Code. Provides that a municipality that is located partially or wholly in a county with a population greater than 500,000 but less than 3,000,000 under specified conditions may expend Motor Fuel Tax street or road funds (except Federal-aid funds) on streets or highways or sections of highways without prior review or approval of the Department of Transportation for routine maintenance activities as determined by the Department, including without limitation snow plowing, street cleaning, crack-sealing, and road patching; and routine and periodic roadway resurfacing activities (including grinding off the surface course of roads, but not involving expansions or reconstruction of more than 20% of the affected road bed). Unless otherwise agreed by the parties, requires a sanitary district that locates its facilities within the railroad right-of-way for a crossing, other than a crossing along the public roads of this State pursuant to the Telephone Line Right of Way Act, to pay the railroad a one-time standard crossing fee of $750 for each crossing. Provides that the standard crossing fee is in lieu of any license or any other fees or charges to reimburse the railroad for its direct expenses incurred as a result of the crossing.
