Provides that the prohibitions on carrying concealed firearms or firearms in a vehicle and carrying firearms on a public way do not apply to parole agents and parole supervisors who meet certain qualifications and conditions. House Amendment No. 1 Deletes provision that limits the types of firearms that parole agents or parole supervisors may carry off-duty to .38 and .40 caliber firearms. House Amendment No. 2 Deletes provision that if death or injury to a person or damage to property occurs as the result of the use of a firearm that the parole agent or parole supervisor is authorized to carry off-duty, the parole agent or parole supervisor must submit to a drug test within 24 hours after the incident. Provides that when a person who has not previously been convicted of or placed on probation for felony prostitution is guilty of felony prostitution, the court, without entering a judgment and with the consent of the person, may sentence the person to probation. Provides that when a person is placed on probation for felony prostitution, the court shall order a period of probation of 24 months and defer further proceedings until the conclusion of the period or until the filing of a petition alleging violation of probation. Amends the Illinois Controlled Substances Act. Establishes penalties for the knowing manufacture or delivery of, or possession with intent to manufacture or deliver, fentanyl. Provides that 3 years shall be added to the term of imprisonment and the maximum sentence shall be increased by 3 years if the substance containing a controlled substance contains any amount of fentanyl (except for violations in which the controlled substance is fentanyl). Amends the Unified Code of Corrections. Provides that probation, periodic imprisonment, or conditional discharge may not be imposed for the knowing manufacture or delivery of, or possession with intent to manufacture or deliver, more than 5 grams of a substance containing fentanyl. Amends the Criminal Code of 1961. Provides that resisting or obstructing a firefighter is a Class A misdemeanor. Provides that if the violation was the proximate cause of an injury to the firefighter, the offender is guilty of a Class 4 felony. Provides that the court shall also sentence the offender to a minimum of 48 consecutive hours of imprisonment or to perform community service for not less than 100 hours as may be determined by the court. Provides that the person shall not be eligible for probation in order to reduce the sentence of imprisonment or community service.
House Amendment No. 2 Provides that it is an affirmative defense to resisting or obstructing a firefighter if a person resists or obstructs the performance of one known by the person to be a firefighter by returning to or remaining in a dwelling, residence, building, or other structure to rescue or to attempt to rescue any person.
