LQR CNTRL ACT-ALCOPOPS

Amends the Liquor Control Act of 1934. Prohibits the advertising, promotion, or marketing of alcopop beverages to children. Provides that any person who violates the Section is guilty of a business offense and shall be fined $500 for a first offense and $1,000 for a second or subsequent offense.

Senate Floor Amendment No. 2
Makes a technical correction. Provides that to advertise, promote, or market alcopop beverages to children includes, but is not limited to, billboards advertising alcopops placed within 500 feet (instead of 1,000 feet) of schools, public parks, amusement parks, and places of worship.

House Amendment No. 1
Changes the definition of "alcopop" to include flavored malt beverages.

TAX RATE-FOREST PRESERVE ZOO Amends the Forest Preserve Zoological Parks Act. Provides that, in a forest preserve district located in a county with a population in excess of 140,000 but less than 200,000 and contiguous to the Mississippi River, the rate of an annual tax for certain purposes concerning the construction, maintenance, and security of a zoological park shall not exceed 0.06% (now .01%). Requires referendum approval by the electors of the District to authorize the tax increase above 0.01%. EMERG TEL SYS-HEARTSAVER

Amends the Emergency Telephone System Act. Provides that a municipality or a county may impose, pursuant to a referendum, a monthly surcharge of $0.10 per network connection for the purpose of purchasing and maintaining automated external defibrillators in schools, parks, and other public places.

MOBILE HOME PARKS-PENALTIES

Amends the Mobile Home Park Act. Provides that the funds received under the Act shall be deposited into the Facility Licensing Fund and shall be used for the enforcement of the Act. Provides that the Department of Public Health may impose an administrative monetary penalty against a person who operates a mobile home park in violation of the Act or the Department's rules. Provides that the Department must provide written notification of the alleged violation and allow a minimum of 10 days for correction before imposing the administrative monetary penalty. Also requires the Department to provide an opportunity for a hearing. Authorizes the Attorney General to bring an action to enforce the collection of an administrative monetary penalty. Provides that administrative monetary penalties shall be deposited into the Facility Licensing Fund. Effective immediately.

MOBILE HOME STORM SHELTERS

Amends the Illinois Income Tax Act. Creates a credit for owners of mobile home parks for 50% of the cost of construction of storm shelters for taxable years ending on or after December 31, 2007. The credit may not be carried back, but may be carried forward for 5 years. Requires the shelter to meet the specifications of a licensed professional engineer. Exempts the credit from the Act's sunset provisions. Amends the Mobile Home Park Act. Authorizes municipalities and counties to require storm shelters or evacuation plans for mobile home park residents.

Amends the Township Code. Provides that certain bond proceeds shall be expended under the direction of the board of trustees of the township (instead of the highway commissioners of the township). Provides that the board of trustees of the township (instead of the highway commissioners of the township) may designate certain parcels of land to be used for the purchase of parks. Effective immediately.

Provides that a majority of the members of the board of trustees of the township may designate that certain bond proceeds be expended under the direction and upon the warrant of the highway commissioner if the highway commissioner provides written consent to that action.

SELL STATE AIRCRAFT

Amends the State Property Control Act. Provides that each State-owned aircraft not designated for emergency use is surplus property and must be sold by whatever method will be most profitable to the State, which may include a widely used global Internet auction site (now, a transferable airplane may be disposed of only if (i) it is no longer needed, (ii) it will not be used as a trade-in, and (iii) a public university or college offering aviation-related instruction or training has not listed its need for an airplane). Requires that the sale proceeds be deposited into the State Parks Fund and used for State park improvements. Effective immediately.

Amends the State Property Control Act. ST PARKS-VERMILION COUNTY Amends the State Parks Act, the State Finance Act, and the Illinois Pension Code. Requires the Department of Natural Resources to lease to the Vermilion county Conservation District, for one dollar, Kickapoo State Park, Harry "Babe" Woodyard State Natural Area, and Middlefork State Fish and Wildlife Area for their operation and management for 2 years. Requires a specified level of State appropriations for the District's use, and authorizes the District to retain revenues generated by the parks. Permits lease renewals. Creates a special fund in the State treasury for appropriations for the parks, and exempts the fund from fund sweeps. MOBILE HOME-LEASE-RENT

Amends the Mobile Home Landlord and Tenant Rights Act. Provides that, if a mobile home park has an occupancy rate of less than 85%, (i) the purchaser of an existing mobile home that is located on a lot in that park may not be charged a rental amount for that lot for the first year of the lease that exceeds the rental amount charged to the prior lessee by more than 6% and (ii) rental amounts for the lease of any mobile home or mobile home lot may not be increased by more than 5% annually. Provides that in any mobile home park, increases in rent must be clearly explained in writing; the explanation must indicate (i) how much the rent has increased as a percentage of the base rent, (ii) the increase or decrease in the Consumer Price Index during the previous 12-month period, and (iii) the dollar amount of the increase per month and annually. Exempts mobile home parks in operation for 5 years or less, regardless of ownership, from these rent limitations.

MOBILE HOME PARK FIRE SAFETY Amends the Mobile Home Park Act. Provides that the agreement required in the case of a mobile home park that does not have a private water supply system and hydrants must be signed and dated by the owner of the mobile home park or his or her representative and by the local fire chief or his or her representative and must be submitted with each application for an original license or license renewal application under the Act. Provides that a mobile home park constructed after January 1, 1998 must be located in an area protected by a fire department or fire protection district and provided with fire hydrants within 500 feet of any structure in the mobile home park. Provides that as an alternative to fire hydrants, a holding pond or other source of water of 100,000 gallons or more accessible to the fire department or fire protection district may be used, if the fire department or fire protection district is capable of pumping from the body of water.
