STATE AGENCIES-NURSE OVERTIME Amends the Department of Children and Family Services Powers Law of the Civil Administrative Code of Illinois, the Mental Health and Developmental Disabilities Administrative Act, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, the Department of Veterans Affairs Act, the Illinois Public Aid Code, and the Unified Code of Corrections. Provides that no nurse who is paid an hourly wage and who has direct responsibility to oversee or carry out nursing care or related duties may be required to work mandated overtime except in the case of an unforeseen emergent circumstance when such overtime is required only as a last resort, and limits the time of such overtime. Provides that when a nurse is mandated to work up to 12 consecutive hours, the nurse must be allowed at least 8 consecutive hours of off-duty time. DHS-CILA-NURSING SERVICES Amends the Community-Integrated Living Arrangements Licensure and Certification Act. Provides that the Department of Human Services shall require that any agency operating a community-integrated living arrangement must provide adequate nursing services to all recipients. Requires the Department to establish graduated standards of basic nursing services that correspond to recipients' ranges of Health Care Levels as reflected in the Health Risk Screening Tool; also requires the Department to establish standards for staffing ratios of Registered Nurses to Direct Support Personnel and Registered Nurses to Licensed Practical Nurses in accordance with a recipient's Health Care Level. MEDICAID-APN-PSYCHIATRIC SRVCS

Amends the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to reimburse advanced practice nurses for psychiatric services they provide, as authorized by Illinois law, to Medicaid recipients. Effective immediately.

House Amendment No. 1
Provides that the Department of Healthcare and Family Services shall reimburse advanced practice nurses for psychiatric services that they provide to recipients of medical assistance "pursuant to a collaborative agreement with a collaborating physician that authorizes the provision of psychiatric services" (instead of "as authorized by Illinois law").

 Fiscal impact is estimated at $525,000 annually.

Authorizes the Illinois Housing Development Authority to develop and implement a program of financial assistance to recently hired Illinois nurses and home-care workers purchasing their first primary residence. Limits the program to nurses and home-care workers employed in Cook County. Limits eligibility to nurses and home-care workers with no more than 2 years of employment who commit to continue working, for at least 3 years after their closing date, in Cook County. Amends the Nursing and Advanced Practice Nursing Act to provide that the scope of practice for licensed practical nurses, licensed registered nurses, and licensed advanced practice nurses includes the authority to prescribe drugs and medicines. Repeals a Section concerning the prescriptive authority of advanced practice nurses. Amends the Ambulatory Surgical Treatment Center Act, the Hospital Licensing Act, the Pharmacy Practice Act of 1987, the Sexual Assault Survivors Emergency Treatment Act, and the Illinois Controlled Substances Act to reflect this prescriptive authority.

MEDICAID-PSYCHIATRIC SERVICES Amends the Illinois Public Aid Code. Provides that a "service provider" may be another entity besides a person or corporation. Provides that the Department of Healthcare and Family Services, by rule, shall apply a comparable, prospective cost-reimbursement methodology for service providers to provide child and adult psychiatric services on an outpatient basis with the stipulation that the service provider meet certain criteria. Provides for reimbursement of advanced practice nurses providing such services at 100% of the established physician rate. Effective January 1, 2008. Respectfully requests that the State Board of Education study and compile statewide data on school nurses and report its findings and recommendations to the General Assembly.

Removes the goal of the State Board of Education's study of mandating a ratio of one credentialed school nurse for every 1,500 pupils for all public schools by the year 2017. Makes a related change in a whereas clause, and makes a technical correction.

STUDENTS WITH DIABETES ACT Creates the Care of Students with Diabetes Act. Requires a diabetes medical management plan to be submitted for any student with diabetes who seeks assistance with diabetes care in the school setting (whether a public or a private school) by the student's parent or guardian. Provides that a school nurse and a volunteer aide shall provide diabetes care for a student only after a student's parent or guardian requests assistance and signs and submits a diabetes medical management plan to the school. Provides for designated diabetes care aides and their training. Sets forth what a student with diabetes must be permitted to do. Requires a school to provide an information sheet to certain school employees concerning a student with diabetes. NURSE LICENSURE COMPACT

Creates the Nurse Licensure Compact Act. Allows for reciprocity of licensure of licensed practical nurses and registered nurses among the states. Provides for administration of the Compact by the Nursing Act Coordinator. Provides that the licensing board shall participate in a Compact Evaluation Initiative designed to evaluate the effectiveness and operability of the Compact. Provides that the Compact does not relieve employers from complying with statutorily imposed obligations. Provides that the Compact does not supersede existing State labor laws. Amends the Nurse Practice Act to make changes relating to the purposes of the Compact. Effective January 1, 2009.
