WILDLIFE-TRAPPING LICENSE

Amends the Wildlife Code. Provides an exemption from the trapping license fee for any Illinois resident who has served as an active duty member of the United States Armed Forces, the Illinois National Guard, or the Reserves of the United States Armed Forces. Effective immediately.

NATL GUARD-HAZMAT EXPOSURE Creates the National Guard Veterans Exposure to Hazardous Materials Act. Provides that on and after October 1, 2007, the Adjutant General shall assist any member of the Illinois National Guard who served in the Persian Gulf War or in an area designated as a combat zone by the President of the United States during Operation Enduring Freedom or Operation Iraqi Freedom who (i) has been assigned a risk level I, II, or III for depleted uranium exposure by his or her branch of service, (ii) is referred by a military physician, or (iii) has reason to believe that he or she was exposed to depleted uranium during such service, in obtaining federal treatment services, including a best practice health screening test for exposure to depleted uranium. Provides that no State funds shall be used to pay for such tests or other federal treatment services. Requires the Adjutant General to submit a report to the General Assembly by October 1, 2007. 50 CALIBER RIFLES Amends the Criminal Code of 1961 relating to the unlawful use of weapons. Prohibits the sale, manufacture, purchase, possession, or carrying of 50 caliber rifles. Provides that a violation is a Class 2 felony, unless the weapon is possessed in the passenger compartment of the a motor vehicle or upon the person, while loaded, in which case a violation is a Class X felony. Exempts: (1) peace officers while in performance of their official duties; (2) wardens, superintendents, and keepers of prisons, penitentiaries, jails, and other institutions for the detention of persons accused or convicted of an offense; (3) members of the Armed Services or Reserve Forces of the United States or the Illinois National Guard, while in the performance of their official duty; and (4) persons licensed under federal law to manufacture those weapons. Appropriates $5,800,000 from the General Revenue Fund to the Illinois Student Assistance Commission for payments of IL National Guard and Naval Militia Scholarships and $43,000,000 to military Veterans' scholarships, as well as $1,800,000 to the Department of Veterans’ Affairs for the payment of scholarships to students who are dependents of Illinois resident military personnel. Effective July 1, 2007.

Amends the Illinois Income Tax Act. Provides that an individual may take an income tax deduction for compensation paid for service in the National Guard of any state (now, only the Illinois National Guard). Effective immediately.

CONTINUING APPROP-SCHOLARSHIP Creates the Continuing Appropriation for Military Scholarships Act to require a General Revenue Fund recommendation by the Governor in the annual budget and annual General Revenue Fund appropriations by the General Assembly sufficient to reimburse institutions of higher learning in this State for not charging students tuition and fees under the Veteran Grant program, the Illinois National Guard Grant and Naval Militia Grant program, and the MIA/POW Scholarship program and to require an irrevocable and continuing appropriation if the General Assembly fails to make sufficient appropriations. Effective July 1, 2007. House Amendment No. 1 Deletes everything after the enacting clause. Reinserts the contents of the bill with the following changes. Amends the Veterans Preference Act. Increases the fine for a violation of the Act to a minimum of $75 (instead of $25) and a maximum of $300 (instead of $100). Effective immediately.

PROP TAX-DISABLD VET FREEZE Amends the Property Tax Code. Creates the disabled veterans assessment freeze homestead exemption for a person who has served in the armed forces of the United States, the reserves of the armed forces of the United States, or the Illinois National Guard and who is disabled. Provides that the amount of this exemption shall be the equalized assessed value of the residence in the taxable year for which application is made minus the base amount. Defines "base amount" as the base year equalized assessed value of the residence plus the first year's equalized assessed value of any added improvements that increased the assessed value of the residence after the base year. Defines "base year" as, in most instances, the taxable year prior to the taxable year for which the applicant first qualifies and applies for the exemption. PROP TX-MILITARY HOMESTEAD Amends the Property Tax Code. Creates the Veterans' Homestead Exemption, under which an annual homestead exemption, limited to $3,000 per year from the property's value is granted for certain property that is used as the primary residence by a veteran. Defines "veteran" as an Illinois resident who: is or has been a member of the Armed Forces of the United States; is a member of the Ready Reserve of the Illinois National Guard while on active military service under an order of the President of the United States; or is a member of any reserve component of the Armed Forces of the United States while on active military service under an order of the President of the United States. Sets forth procedures for the application and grant of the exemption. Amends the Court of Claims Act. Provides that the Court must rule on an Illinois National Guardsman's Compensation Act claim within one year after the petition for that claim is filed with the Court. Effective immediately.

INC TX-VET CHILD CARE CREDIT

Amends the Illinois Income Tax Act. Creates a tax credit for taxpayers who: (i) is allowed the federal Child and Dependent Care Credit; and (ii) is a member or spouse of a member of the Armed Forces of the United States, the Illinois National Guard, or any reserve component of the Armed Forces of the United States, who was deployed during the taxable year on active military duty outside the United States and its territories. Provides that the amount of the credit is the lesser of $1,000 or the amount of the federal tax credit. Provides that the credit may not be carried forward or back and may not reduce the taxpayer's liability to less than zero. Effective immediately.

VETERANS-CAMP AND HUNT FEES Amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois, the Fish and Aquatic Life Code, and the Wildlife Code to allow members of the United States Armed Forces, the Illinois National Guard, and the Reserves of the United States Armed Forces returning from service abroad to camp and hunt without paying fees if the qualifying person applies for a pass at the Department office in Springfield "after" (rather than "within 2 years of") returning from service abroad. Effective immediately. House Amendment No. 1 Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill with changes. Provides that no camping, fishing, and hunting fees shall be charged to servicemen and servicewomen returning from service abroad or mobilization for as long as they maintain Illinois residency (instead of the amount of time they spent in service abroad or mobilized).
