RAILROAD POLICE-MISCONDUCT Amends the Railroad Police Act. Requires allegations of abuse of authority or misconduct by members of a railroad police force to be investigated by the Illinois State Police. Amends the Illinois Vehicle Code. Exempts elected representatives of rail carriers from the restrictions concerning trespassing on railroad property. Provides that the listed persons shall be exempt from the restrictions while performing required duties in accordance with reasonable rail carrier company guidelines, engaging in safety inspections, or exercising a right under the federal Railway Labor Act (instead of just while performing required duties in accordance with reasonable rail carrier company guidelines). ELECTROLOGST-DELEGATE-GRNDFTHR Amends the Medical Practice Act of 1987. Provides that nothing in the Act shall be construed to limit the right of persons licensed under the Act to delegate tasks or duties to licensed or unlicensed personnel who have the training or experience to perform the tasks or duties so delegated. Amends the Electrologist Licensing Act. Provides that nothing in the Act shall be construed to prevent a person functioning as an assistant to a person licensed to practice medicine in all its branches from being delegated tasks or duties for which he or she has the training or experience to perform (instead of from providing electrology services). Provides that the Department of Financial and Professional Regulation may issue a license to an individual who failed to apply for licensure under the grandfathering provision of the Act within one year after the effective date of the rules adopted under the Act, but who otherwise meets the qualifications set forth [...]

GENETIC INFORMATION PRIVACY Amends the Genetic Information Privacy Act. Adds several definitions. Provides that the Act applies to the State and local governments. Provides that an employer, employment agency, labor organization, and licensing agency shall not directly or indirectly do any of the following: (1) solicit, request, require or purchase genetic information of a person or administer a genetic test to a person as a condition of employment, preemployment application, labor organization membership, or licensure; (2) affect the terms, conditions, or privileges of employment, preemployment application, labor organization membership, or licensure, or terminate the employment, labor organization membership, or licensure of any person because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); (3) limit, segregate, or classify employees [...]

PEN CD-CHIC MUNI-DUTY DISABLTY Amends the Chicago Municipal Article of the Illinois Pension Code. Provides that, before any action is taken by the Board on an application for a duty disability benefit or a widow's compensation or supplemental benefit, the employee or widow shall file a claim with the employer to establish that the disability or death occurred while the employee was acting within the scope of and in the course of his or her duties. Provides an offset of disability benefits for any amounts provided to the employee or surviving spouse as temporary total disability payments, permanent disability payments, a lump sum settlement award, or other payment under the Workers' Compensation Act or the Workers' Occupational Diseases Act. Makes other changes concerning disability benefits. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately. House Amendment No. 3

PENSION-CHI LABOR-DISAB OFFSET Amends the Chicago Laborers Article of the Illinois Pension Code. With respect to certain duty and ordinary disability benefits and widow's compensation and supplemental benefits payable by the Fund, replaces existing provisions relating to the offset of amounts received under the Workers' Compensation Act or Workers' Occupational Diseases Act or related settlements with new provisions applying to those offsets and the administration, commencement, and amount of those benefits. MINORITY MENTAL HLTH AWARENESS Amends the Department of Human Services Act. Requires the Department to include mental health awareness, education, and outreach materials within its public health promotion programs and information to be directed toward minority population groups in Illinois. Provides that this information shall inform members of minority communities about mental illness, the types of services and supports available, and how treatment may be obtained. Requires the Department to collaborate with community-based mental health agencies in the delivery of the information to community leaders and other interested parties in minority communities. COURT OF CLAIMS-PRISONERS Amends the Personnel Code. Establishes a preference in the form of an entitlement to appear on the list of those eligible for appointments, if the person otherwise qualifies through testing for a person if: (i) he or she has been discharged from a prison of this State; (ii) he or she has been wrongfully accused of a crime for which he or she was imprisoned; and (iii) either a court of competent jurisdiction finds that the evidence that resulted in his or her conviction was erroneous or that new evidence indicates that the person did not commit the crime for which he or she was imprisoned or the accused received a pardon from the Governor stating that such pardon is issued on the ground of innocence of the crime for which he or she was imprisoned.
