DPT VET AFF-VET ORGANIZATIONS

Amends the Department of Veterans Affairs Act. Subject to appropriations, requires the Department to pay veterans service organizations for services provided by veterans service officers in processing claims and other benefits for veterans and their spouses or other beneficiaries residing in Illinois. Requires payment at the rate of $0.010 for each dollar of benefits obtained for veterans or their spouses or other beneficiaries. Sets forth criteria that a veterans service organization must meet.

Senate Committee Amendment No. 1
Adds an immediate effective date to the bill.

House Amendment No. 3
Deletes everything after the enacting clause. Reinserts the provisions of House Amendment 1. Provides that the payments to veterans service organizations are subject to appropriation. Provides that "veterans services" means the representation of veterans at federal hearings to secure certain benefits.

AGRICULTURAL FAIR ACT-FUNDING

Amends the State Finance Act. In fiscal year 2014 and in each fiscal year thereafter, requires the transfer from the General Revenue Fund to the Agricultural Premium Fund and the Fair and Exposition Fund of amounts equal to 100% of the total statutory payments required from those special funds for that fiscal year to county fairs and fair and exposition authorities under the Agricultural Fair Act. In each of the fiscal years 2009 through 2013, requires transfer of an amount equal to a lower, specified percentage of those total statutory payments. Provides that the required transfer amounts are the maximum amounts to be transferred in each fiscal year, notwithstanding any other law to the contrary. Amends the Agricultural Fair Act. With respect to the distribution formula for premiums to county fairs, uses either of the 2 previous fiscal years (now, either fiscal year 1984 or 1985). Effective immediately.

STATE AGENCIES-NURSE OVERTIME Amends the Department of Children and Family Services Powers Law of the Civil Administrative Code of Illinois, the Mental Health and Developmental Disabilities Administrative Act, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, the Department of Veterans Affairs Act, the Illinois Public Aid Code, and the Unified Code of Corrections. Provides that no nurse who is paid an hourly wage and who has direct responsibility to oversee or carry out nursing care or related duties may be required to work mandated overtime except in the case of an unforeseen emergent circumstance when such overtime is required only as a last resort, and limits the time of such overtime. Provides that when a nurse is mandated to work up to 12 consecutive hours, the nurse must be allowed at least 8 consecutive hours of off-duty time. ETHICS-LOCAL REFERENDA

Amends the State Officials and Employees Ethics Act and the Election Code. Provides that communication to the public by the corporate authorities of a unit of local government or school district explaining a decision to place a public question on the ballot or explaining support of or opposition to a public question does not constitute a prohibited political activity or election interference. Requires that the corporate authorities in the communication specify how the referendum will directly affect residents' health, safety, or welfare or the unit's or district's government or affairs. Effective immediately.

Amends the Police Training Institute Act. Provides that the training offered in the Police Training Institute shall be under the direction of the Office of the Provost and Vice Chancellor for Academic Affairs at the University of Illinois at Urbana-Champaign (rather than the Division of University Extension Services of the University). Effective immediately.

NATL GUARD-HAZMAT EXPOSURE Creates the National Guard Veterans Exposure to Hazardous Materials Act. Provides that on and after October 1, 2007, the Adjutant General shall assist any member of the Illinois National Guard who served in the Persian Gulf War or in an area designated as a combat zone by the President of the United States during Operation Enduring Freedom or Operation Iraqi Freedom who (i) has been assigned a risk level I, II, or III for depleted uranium exposure by his or her branch of service, (ii) is referred by a military physician, or (iii) has reason to believe that he or she was exposed to depleted uranium during such service, in obtaining federal treatment services, including a best practice health screening test for exposure to depleted uranium. Provides that no State funds shall be used to pay for such tests or other federal treatment services. Requires the Adjutant General to submit a report to the General Assembly by October 1, 2007. Amends the Department of Veterans Affairs Act. Creates the Operation Enduring Freedom and Operation Iraqi Freedom Fund. Authorizes the payment of bonuses to qualifying military personnel or their survivors. Sets forth requirements and conditions. Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Effective July 1, 2008.
