ILLINOIS CLIMATE CHANGE ACT

Creates the Illinois Climate Change Act. Provides that the Governor, subject to the advice and consent of the Senate, shall appoint to the Environmental Protection Agency a Deputy Director for Climate Change to supervise Agency programs designed to reduce the greenhouse gas emissions level in this State. Provides that the Agency shall conduct an inventory of greenhouse gas emissions in the State. Provides that the Agency shall report its findings to the Governor and the General Assembly and that, by July 1, 2008, the Agency shall present to the Governor and General Assembly a plan to significantly reduce the greenhouse gas emissions level in the State by the year 2020. Requires the Agency to consult with other states and the federal government about the most effective strategies and methods to reduce greenhouse gases. Effective immediately.

GREEN GOVERNMENTS ILLINOIS Creates the Green Governments Illinois Act. Provides for the creation of the Green Governments Coordinating Council and sets out the composition and responsibilities of the Council. Gives the Council the authority to solicit and receive grants to fulfill the Council's functions and to solicit, use, and publish advice and information to assist in the Council's duties. Provides that participation in the Green Governments Illinois program by units of State and local government and educational institutions is voluntary. Sets out responsibilities of State agencies under the Act. Provides that a member of the Lieutenant Governor's staff shall be responsible for the establishment and maintenance of a Green Governments Illinois website with specified content. IEPA-CITIZENS COMPLAINTS Amends the Environmental Protection Act. Authorizes the Agency to collect and solicit citizen complaints alleging a violation of the Act, any rule adopted under the Act, a permit granted by the Agency, or a condition of a permit via telephone, website, fax, mail, e-mail, or any other reasonable means. Provides that the Agency may accept citizen complaints that are anonymous and unaccompanied by the name and mailing address of the complainant, except that, for complaints alleging a violation arising out of agricultural production, the complainant must provide his or her name and mailing address. Sets forth that the Agency must keep the name and address of the complainant confidential, subject to certain penalties. Exempts the name and address of these complainants from public disclosure under provisions of the Act authorizing reasonable public inspection. Defines "agricultural production". Effective immediately.

EPA-LIVESTOCK NUISANCE SUITS

Amends the Environmental Protection Act. Provides that no person may bring a civil suit based on potential nuisance with respect to a proposed livestock management facility until all required federal, State, and local permits and approvals for the proposed facility have been granted. Provides that, from the time when all required federal, State, and local permits and approvals have been granted until animals are present and operations have actually begun at the proposed facility, it shall be presumed that a proposed livestock management facility can be lawfully operated in accordance with those permits. Includes related findings and declarations. Effective immediately.

Amends the Environmental Protection Act. With respect to the additional 50-cent new or used tire fee collected from retail customers, eliminates a provision terminating the fee on January 1, 2008. Makes revisory changes. Effective July 1, 2007.

EPA-COMPOSTING-RECYCLING-REUSE

Amends the Environmental Protection Act. Provides 3 additional exceptions to the definition of "pollution control facility" under the Act, as follows: (i) the portion of a site or facility, that has no more than 10,000 cubic yards of specified materials or that has no more than 30,000 cubic yards of material if the compost facility is part of a required Waste Management Plan that has been developed in accordance with the standards of the Livestock Management Facilities Act; (ii) the portion of a site or facility that has no more than 5,000 cubic yards of specified materials, that uses certain wastes including food waste and landscape waste and meets certain location criteria; and (iii) the portion of a site or facility used for a recycling, reclamation, or reuse operation subject to certain permitting requirements of the Act. Defines "food waste". Effective immediately.

EPA-RECYCLING REUSE WASTE

Amends the Environmental Protection Act. In a definitions Section, provides that the term "waste" does not include discarded materials that are: (i) collected for recycling; (ii) processed for recycling; or (iii) recovered for reuse (now, waste includes all discarded material). Defines "reclamation", "recycling", and "reuse" as individual terms (now, single definition for recycling, reclamation, or reuse). Amends the Solid Waste Planning and Recycling Act and the Solid Waste Management Act to make corresponding changes. Effective immediately.

PRIVATE SEWAGE-OFF LOT SYSTEMS Amends the Private Sewage Disposal Licensing Act. Defines "off-lot discharging private sewage disposal system". Provides that every owner of an off-lot discharging private sewage disposal system must file a "Notice of Intent" with the Department of Public Health to allow coverage of the system under the blanket National Pollutant Discharge Elimination System (NPDES) permit of the State.
