MORT CERTIF RELEASE-PENALTY Amends the Mortgage Certificate of Release Act. Provides that, if any title insurance company or its duly appointed title insurance agent, knowing the mortgage to be paid pursuant to the lender's written payoff statement, fails to file a certificate of release within one month after the payment of the debt secured by the mortgage or trust deed, the title company shall be liable for and pay to the party aggrieved the sum of $200, for each offense, which may be recovered by the party aggrieved in a civil action together with reasonable attorney's fees. Provides that, in any such action, introduction of a loan payment book or receipt that indicates that the obligation has been paid shall be sufficient evidence to raise a presumption that the obligation has been paid. Provides that, upon a finding for the party aggrieved, the court shall order the title insurance company or its duly appointed title insurance agent, to make, execute, and deliver the certificate [...]

Creates the Consumer Protection Against Computer Spyware Act. Sets forth provisions for unauthorized collection or culling of personally identifiable information, unauthorized access to or modifications of computer settings and computer damage, unauthorized interference with installation or disabling computer software, and other prohibited conduct. Provides that certain persons may bring a civil action against a violator of the Act. Provides civil penalties for violations of the Act. Permits the Attorney General to obtain a restraining order or injunction for violations of the Act.

RETAIL CONSUMER PROTECTION ACT Creates the Retail Consumer Protection Act. Provides that all businesses engaged in retail commerce shall have a designated employee who has the responsibility for ensuring the accuracy of all posted and advertised prices. Provides that the person designated for ensuring the accuracy of all posted and advertised prices shall keep a written record of any customer complaints received concerning any overcharging or other acts of consumer fraud, unfair methods of competition, and deceptive business practices. Requires the record to be kept for no less than 2 years and made available to investigators of the Department of Agriculture Bureau of Weights and Measures upon request. Provides that any person engaged in retail commerce that is alerted by a customer of any overcharging shall immediately report the overcharge to the person designated for ensuring the accuracy of posted and advertised prices, who shall investigate the alleged error. Sets forth provisions regarding unauthorized collection or culling of personally identifiable information, unauthorized access to or modifications of computer settings and computer damage, unauthorized interference with installation or disabling computer software, and other prohibited conduct. Provides that certain persons may bring a civil action against a violator of the Act. Provides a civil penalty for violations of the Act. Permits the Attorney General to obtain a restraining order or injunction for violations of the Act.

Exempts willful and wanton misconduct from the limitation of liability of a manufacturer or retailer of computer equipment for providing third-party branded software loaded on the equipment they are manufacturing or selling.

RETAIL CONSUMER PROTECTION ACT

Creates the Retail Consumer Protection Act. Provides that certain businesses engaged in retail commerce shall have at least one designated employee responsible for ensuring the accuracy of posted and advertised prices and resolving customer complaints related to the accuracy of prices. Provides that any person engaged in retail commerce who is alerted by a customer of overcharging shall immediately report the overcharge to the designated employee, who shall investigate the alleged error. Provides that the Department of Agriculture shall maintain a hotline to receive complaints. Provides that the Director of Agriculture shall: provide an annual written report describing activities to implement the Act and any substitute local ordinances; and adopt rules. Establishes penalties. Amends the Weights and Measures Act to grant city sealers the powers established in the Retail Consumer Protection Act.

PHARMACEUTICAL CONSUMER PROTEC

Creates the Pharmaceutical Consumer Protection Act. Provides that, with regard to a prescription for a drug that is written by a prescriber within Illinois or that is dispensed within Illinois, a prescriber, company, pharmacy, or prescription drug information intermediary may not license, use, sell, transfer, or exchange for value, for any commercial purpose, prescription drug information that identifies directly or indirectly the individual or the prescriber, with specified exceptions. Provides that any person who violates any provision of the Act commits an unlawful practice within the meaning of the Consumer Fraud and Deceptive Business Practices Act, and makes a corresponding change in the Consumer Fraud and Deceptive Business Practices Act. Effective immediately.
