UCC-FILING

Amends the Uniform Commercial Code in relation to secured transactions. Provides that filing does not occur with respect to a record that a filing office refuses to accept (i) where the filing office is unable to index the record because in the record submitted the debtor does not meet the definition of a transmitting utility, and (ii) in the case of an initial financing statement or an amendment if the filing office believes in good faith that a document submitted for filing is being filed for the purpose of defrauding any person or harassing any person in the performance of duties as a public servant.

House Amendment No. 1
Provides that the Secretary of State may refuse to accept a record for filing under the amendatory provisions added by the engrossed bill only if the refusal is approved by the Department of Business Services of the Secretary of State and the General Counsel to the Secretary of State.

Amends the Uniform Commercial Code. Makes changes to Article 1, which deals with general provisions, and Article 7, which deals with documents of title, in conformance with recommendations of the National Conference of Commissioners of Uniform State Laws. Makes conforming changes in other parts of the Uniform Commercial Code.

Senate Committee Amendment No. 1
Provides that the owner of a self-service storage facility, as defined in the Self-Service Storage Facility Act, is not a warehouse for purposes of Article 7.

House Amendment No. 1
Provides that Article 1 of the Code modifies, limits, and supersedes the federal Electronic Signatures in Global and National Commerce Act, except that nothing in Article 1 modifies, limits, or supersedes specified provisions of that Act or authorizes electronic delivery of any of the notices described in specified provisions of that Act.

MANUFACTURED HOUSING BUYERS Creates the Manufactured Housing Buyer Protection Act. Provides that, if, after a reasonable number of attempts, the seller of a manufactured housing unit is unable to conform the manufactured housing unit to any of its applicable express warranties, then the manufacturer must either provide the consumer with a new manufactured housing unit of like model line, if available, or otherwise a comparable manufactured housing unit as a replacement, or accept the return of the manufactured housing unit from the consumer and refund to the consumer the full purchase price or lease cost of the new manufactured housing unit, including all collateral charges, less a reasonable allowance for consumer use of the manufactured housing unit, but only when the consumer has first resorted to an informal settlement procedure applicable to such disputes.
