SCH CD-ST AID-CONSOLIDATE DIST Amends the School Code. With respect to transitional assistance payments, provides that the State Board of Education shall adjust prior year information for the transitional assistance calculations in the event of the creation or reorganization of a school district, the dissolution of an entire district and the annexation of all of its territory to one or more other districts, or a boundary change whereby the enrollment of the annexing district increases by 90% or more as a result of annexing territory detached from another district. Provides that those districts whose enrollment increases by 90% or more as a result of annexing territory detached from another district are eligible for certain supplementary State aid payments. Provides that the changes made by the amendatory Act are intended to be retroactive and applicable to any annexation taking effect on or after July 1, 2004. Effective immediately. MUNI CD-ANNEX NOTICE SCHOOL Amends the Illinois Municipal Code. Provides that, when any land is proposed to be annexed to a municipality, the corporate authorities of each school district potentially affected by the proposed annexation shall be notified by the municipality in writing by certified or registered mail before any court hearing or other action is taken for annexation. Establishes procedures for the service of the notice. Provides that the annexation is not effective without service. Effective immediately. Senate Floor Amendment No. 1 Deletes everything after the enacting clause. Amends the Illinois Municipal Code. Provides that, when any land proposed to be annexed is part of a school district, the annexing municipality shall notify that school district in writing sent by certified or registered mail at least 10 days prior to any public hearing for annexation. CTY CD-REFUND CASH CONTRIB Amends the Counties Code and the Illinois Municipal Code. Provides that any request for refund of cash contributions paid in lieu of land donations and pursuant to a county or municipal ordinance must be filed (i) within one year after the date of payment or a longer period specified in a county or municipal ordinance or an annexation agreement if the request is based on an objection to the validity of an ordinance or to the manner in which donations or contributions are calculated under an ordinance or (ii) within one year after the objector knew or should have known that the money has been spent if the request is based on an objection that the contribution was spent in a manner inconsistent with the county or municipal ordinance but, in any case, must be filed within 5 years after the money has been spent. MUNI CD ANNEXATION RR UTILITY Amends the Illinois Municipal Code. Provides that any unincorporated territory containing 60 acres or less may be annexed by any municipality by which it is bounded if it is wholly bounded by one or more municipalities in a county with a population of more than 800,000 inhabitants and less than 2,000,000 inhabitants and either (i) a utility right-of-way that is at least 100 feet wide or (ii) a railroad or operating property, as defined in the Property Tax Code, being immediately adjacent to, but exclusive of the property. Provides that railroad property shall not be subject to the zoning or jurisdiction of the municipality annexing the territory, nor shall the utility property be included for purposes of calculating the territory annexed. Provides that lands used primarily for agricultural purposes or to produce agricultural goods may not be annexed under certain provisions of the Section. Effective immediately. MUNI CD-ANNEXATION

Amends the Illinois Municipal Code. Provides that, except for property located in certain counties, if property that is the subject of an annexation agreement is located more than 1.5 miles from the corporate boundaries of the annexing municipality, that property is subject to the ordinances, control, and jurisdiction of the annexing municipality unless the county board retains jurisdiction by the affirmative vote of two-thirds of its members (now, the county board may retain jurisdiction in Boone, DeKalb, Grundy, Kankakee, Kendall, LaSalle, Ogle, or Winnebago County). Effective immediately.
