EPA-RIVER EDGE/RIGHT-TO-KNOW

Amends the Illinois Income Tax Act and the Environmental Protection Act. Sets forth standards for the Environmental Protection Agency's review of remediation costs with respect to the River Edge Redevelopment Zone site remediation tax credit. Requires the Agency to issue a notice when the Agency seals any equipment, vehicle, vessel, aircraft, or other facility that is contributing to an emergency condition that creates an immediate danger to health. Effective immediately.

 Fiscal Note (Illinois Environmental Protection Agency)
 SB 1243 would not have any fiscal impact on the Illinois EPA. Because the bill simply makes cleanup changes to last year's Rivers Edge legislation, the fiscal impact should be revenue neutral.

USE/OCC-AIRCRAFT PARTS

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides a tax exemption under the Acts beginning July 1, 2007, for aircraft and parts and supplies that are purchased and used to overhaul, rebuild, refurbish, or remodel an aircraft. Effective immediately.

CRIM CD-FORFEITURE PROCEEDS Amends the Criminal Code of 1961 in relation to the distribution of the proceeds from the sale at public auction of forfeited vehicles, vessels, and aircraft. Provides that: (1) 65% of the proceeds shall be distributed to the local, municipal, county, sheriff, or State law enforcement agency or agencies that conducted or participated in the investigation resulting in the forfeiture; (2) 25% shall be distributed to the Office of the State's Attorney of the county in which the prosecution resulting in the forfeiture was instituted; and (3) 10% shall be retained by the Department of State Police for expenses related to the administration and sale of forfeited property. Provides for the deduction of actual, but reasonable, charges and expenses incurred by the sheriff in storing such vehicles, vessels, and aircraft. Effective immediately. SELL STATE AIRCRAFT

Amends the State Property Control Act. Provides that each State-owned aircraft not designated for emergency use is surplus property and must be sold by whatever method will be most profitable to the State, which may include a widely used global Internet auction site (now, a transferable airplane may be disposed of only if (i) it is no longer needed, (ii) it will not be used as a trade-in, and (iii) a public university or college offering aviation-related instruction or training has not listed its need for an airplane). Requires that the sale proceeds be deposited into the State Parks Fund and used for State park improvements. Effective immediately.
