CRIMINAL LAW-VARIOUS Amends the Criminal Code of 1961 and certain other Acts. Moves, adds, deletes, repeals, and changes certain provisions. Adds or changes mental states for certain offenses. Changes certain statutory evidence presumptions to permissive inferences. AMBULAT SURG TRTMT CNTR-ABORTN

Amends the Ambulatory Surgical Treatment Center Act. Provides that notwithstanding any other statute, rule, or regulation to the contrary, an ambulatory surgical treatment center where abortions are performed must comply with all of the statutes, rules, and regulations applicable to ambulatory surgical treatment centers generally.

CRIM CD-HEINOUS BAT UNBORN

Amends the Criminal Code of 1961. Creates the offense of heinous battery of an unborn child. Defines the offense as intentionally or knowingly without medical legal justification extracting by cutting, severing, mutilating, or otherwise causing by force the unnatural expulsion of an independently viable fetus from the uterus of another living human being. Provides that the penalty is a Class X felony for which a person shall be sentenced to a term of imprisonment of not less than 6 years and not more than 45 years. Exempts from this offense acts that cause bodily harm to an unborn child if those acts were committed during any abortion to which the pregnant woman has consented and acts that were committed pursuant to usual and customary standards of medical practice during diagnostic testing or therapeutic treatment.

ADOLESCENT HEALTH CARE SAFETY Creates the Adolescent Health Care Safety Act. Provides that a person may not intentionally perform an abortion on a minor or on an incompetent person unless 48 hours' notice has been given to a specified adult family member or a member of the clergy. Provides for exceptions to the notice requirement. Requires a minor's consent to an abortion, except in the case of a medical emergency. Provides that the provision of information and counseling by a physician or counselor for a pregnant minor for decision making regarding pregnancy shall be in accordance with specified requirements. Requires the Department of Public Health to make certain reports. Provides that a physician who intentionally fails to comply with the Act shall be referred to the Medical Disciplinary Board for any appropriate action. Provides that the unauthorized signing of a waiver of notice or the unlawful disclosure of confidential information is a Class C misdemeanor. Repeals the [...]
