Authorizes municipalities that impose certain taxes or fees on or collected by public utilities to conduct audits of those utilities to determine the accuracy of the taxes or fees paid to the municipality. Sets forth procedures under which a municipality may collect information from a public utility that is necessary to perform an audit. Sets forth procedures concerning the audit findings, liability for errors, penalties, confidentiality, and exemptions. Amends the Local Government Taxpayers' Bill of Rights Act. Limits the authority of municipalities (including home rule municipalities) to impose penalties with respect to certain taxes imposed under the Illinois Municipal Code or with respect to the municipal electricity infrastructure maintenance fee. Amends the Illinois Power Agency Act and the Public Utilities Act to provide that on the effective date of the amendatory Act, all powers and duties of the Illinois Commerce Commission under the Public Utilities Act shall be transferred to the Illinois Power Agency, and references in other Sections of the Public Utilities Act to the Illinois Commerce Commission shall be deemed to refer to the Illinois Power Agency. Provides that all rules, standards, and procedures adopted by the Illinois Commerce Commission under this Act shall continue in effect as the rules, standards, and procedures of the Illinois Power Agency, until they are modified or abolished by the Illinois Power Agency. Provides that any gas utility may enter into a contract for up to 20 years of supply with any company for the purchase of synthetic natural gas (rather than a 20-year supply contract with any company for synthetic natural gas) produced from coal through the gasification process if the company has commenced construction of a coal gasification facility by July 1, 2009 (rather than July 1, 2008). Makes changes in factors used to determine whether the cost for synthetic natural gas is reasonable and prudent. Effective immediately.
Senate Committee Amendment No. 1 Provides that if the Illinois Commerce Commission determines that the cost for synthetic natural gas purchased under a specified contract during supply years 11 through 20 (rather than during years 11 through 20) is not reasonable and prudent, then the company shall reimburse the utility for a specified amount.
