UTILITIES-PUBLIC UTIL FUND Amends the Public Utilities Act. Provides that if the amount determined as provided in specified provisions exceeds 50% of the previous fiscal year's appropriation level (instead of $5,000,000), the Illinois Commerce Commission shall then compute the proportionate amount, if any, which (x) the tax paid hereunder by each utility during the preceding biennium, and (y) the amount paid into the Public Utility Fund during the preceding biennium by the Department of Revenue pursuant to Sections 2-9 and 2-11 of the Electricity Excise Tax Law, bears to the difference between the amount determined as provided in specified provisions. Amends the Illinois Vehicle Code. Provides that the Commission shall administer fees and taxes under specified provisions in such a manner as to insure that any surplus generated or accumulated in the Transportation Regulatory Fund does not exceed 50% of the previous fiscal year's appropriation (instead of the surplus accumulated [...]

EMERGENCY SYS PROVIDERS-CERT Amends the Emergency Telephone System Act. Provides that all 9-1-1 system providers must comply with specified requirements in the Public Utilities Act. Amends the Public Utilities Act. Provides that, beginning July 1, 2009, it shall be unlawful for any 9-1-1 system provider to offer or provide or seek to offer or provide to any emergency telephone system board or 9-1-1 system, or agent, representative, or designee thereof, any network or database service used or intended to be used by any emergency telephone system board or 9-1-1 system for the purpose of answering, transferring, or relaying requests for emergency services, or dispatching public safety agency personnel in response to requests for emergency services, unless the 9-1-1 system provider has applied for and received a Certificate of 9-1-1 System Provider Authority from the Illinois Commerce Commission. INFO TECH-REPORT CHILD PORN Amends the Abused and Neglected Child Reporting Act. Provides that if an electronic and information technology equipment worker discovers any depiction of child pornography while installing, repairing, or otherwise servicing an item of electronic and information technology equipment, that worker shall immediately report the discovery to the local law enforcement agency. Provides that an electronic and information technology equipment worker who reports a discovery of child pornography as required under this provision is immune from any criminal, civil, or administrative liability in connection with making the report. Provides that notwithstanding the definition of "eligible customer" in a specified provision, each electricity provider shall allow meter aggregation for the purposes of net metering eligible renewable electrical generating facilities owned or operated by school districts, community college districts, or units of local government pursuant to an intergovernmental agreement. Provides that electricity providers shall provide net metering to all parties to the intergovernmental agreement so that all energy produced by the eligible renewable electrical generating facilities is applied as a 1:1 kilowatt hour credit for each party to the intergovernmental agreement. ICC-LABOR WAGES-CERTIFICATE

Amends the Common Carrier by Pipeline Law in the Public Utilities Act. Provides that no certificate of good standing issued by the Illinois Commerce Commission shall be valid unless the common carrier by pipeline provides all employees a wage of no less than the general prevailing hourly rate as paid for work of a similar character in the locality in which the work is performed as prescribed by the Prevailing Wage Act. Provides that the Commission may require the Illinois Department of Labor to certify a common carrier by pipeline's compliance with specified provisions. Provides that the Commission may reinstate a certificate in good standing to a common carrier by pipeline upon receiving reasonable evidence that the common carrier by pipeline has complied with specified provisions. Effective immediately.

UTILITIES-VILLAGE-WATERWORKS

Amends the Illinois Municipal Code. Provides that the Village of Woodridge may not acquire, construct, contract to construct, or maintain a waterworks or sewerage system outside of its corporate boundaries or planned boundaries without the approval by the Illinois Commerce Commission of a certificate of public convenience and necessity. Amends the Public Utilities Act. Provides that the Village of Woodridge shall not begin the construction of, or contract for the construction of, any waterworks or sewerage system outside of its corporate boundaries or planned boundaries unless and until it shall have obtained from the Commission a certificate that public convenience and necessity require such construction. UTILITIES-CUST COMPENSATION Amends the Public Utilities Act. Provides that in the event that more than 0.8% (rather than 30,000) of the total customers of an electric utility are subjected to a continuous power interruption of 4 hours or more that results in the transmission of power at less than 50% of the standard voltage, or that results in the total loss of power transmission, the utility shall be responsible for compensating customers affected by that interruption for 4 hours or more for all actual damages, which shall not include consequential damages, suffered as a result of the power interruption. Provides that in the event of a power surge or other fluctuation that causes damage and affects more than 0.8% (rather than 30,000) of the customers, the electric utility shall pay to affected customers the replacement value of all goods damaged as a result of the power surge or other fluctuation unless the utility can show that the power surge or other fluctuation was due to [...]

UTILITIES-CUSTOMER SERVICE

Amends the Public Utilities Act. Provides that a public utility shall maintain a live operator or service representative, rather than a voice recording, to answer customer service and on-site service calls within 3 minutes of the customer placing the call concerning service. Provides that, if on-site service is required, then a public utility shall provide the customer with a 3-hour time period during which the utility's service representatives must arrive at the customer's location. Specifies fines levied against a public utility for the failure of a service representative to arrive at the customer's location on time. Provides that the Illinois Commerce Commission shall promulgate rules to implement the specified requirements. Effective immediately.

UTILITIES-ACCT-PROHIBIT MINOR Amends the Public Utilities Act. Provides that no account for a utility service by a public utility that serves over 2,000,000 residential customers shall be in the name of a person under the age of 18, unless that person is an emancipated minor. Provides that such a utility is not entitled to any payment on a service account transferred into the name of a person under the age of 18, unless that person is an emancipated minor. Provides that any utility that serves over 2,000,000 residential customers that unknowingly opens a service account in the name of or transfers a service account to a person under the age of 18 who is not an emancipated minor and reports a delinquent debt on the account to a credit reporting agency, collection agency, or person licensed to market utility services in the State of Illinois shall request that the delinquent debt report on the service account be removed from the minor's credit history as soon as possible after [...]

UTILITIES-SYNTHETIC NATURL GAS

Amends the Public Utilities Act. Provides that any gas utility may enter into a contract for up to 20 years of supply with any company for the purchase of synthetic natural gas (rather than a 20-year supply contract with any company for synthetic natural gas) produced from coal through the gasification process if the company has commenced construction of a coal gasification facility by July 1, 2009 (rather than July 1, 2008). Makes changes in factors used to determine whether the cost for synthetic natural gas is reasonable and prudent. Effective immediately.

Senate Committee Amendment No. 1
Provides that if the Illinois Commerce Commission determines that the cost for synthetic natural gas purchased under a specified contract during supply years 11 through 20 (rather than during years 11 through 20) is not reasonable and prudent, then the company shall reimburse the utility for a specified amount.
