Latest Action: 08/26/2008 - Governor Amendatory Veto Bill TextHUMAN RTS, FAIRNESS IN LENDING Creates the Mortgage Steering Act. Prohibits mortgage loan steering or other specified fee and loan practices, based upon (i) the borrower's credit history, (ii) the borrower's capacity to repay the loan, and (iii) the property on which the loan is secured, because of that borrower’s race, gender, age, disability, or national origin. Provides that the Attorney General shall enforce the Act and grants the Attorney General the additional listed enforcement powers. Provides for injunctive relief, restitution, and civil penalties for violations of the Act. Provides that a person who suffers actual damages as a result of a violation of the Act by a lender may bring an action against that lender and may be awarded actual economic damages or any other relief that the court deems proper. In the definition of "place of public accommodation", deletes the existing examples and inserts language listing facilities that are considered public accommodations for purposes of the Article. Provides that it is a civil rights violation to deny or refuse full and equal enjoyment of goods of any place of public accommodation. Amends the Illinois Human Rights Act. Provides that it is a civil rights violation for an employer to procure a consumer report for employment purposes where any information contained in the consumer report bears on an individual's creditworthiness, credit standing, or credit capacity. Provides that the prohibition does not apply if the information is substantially job related and the employer's reasons for the use of the information are disclosed to the individual in writing or the information is required by law. Effective immediately.
