FIRE SAFETY-IMITATE SPRINKLER Creates the Fire and Life Safety Device Act. Provides that the manufacture, installation, or sale of any device or object that reasonably appears to be a smoke detector, sprinkler head, carbon monoxide alarm, heat detector, or any other similar device used for life safety or fire protection that is, in fact, neither designed nor capable of performing such life safety or fire protection function, is prohibited. Establishes penalties for violations of the Act. Provides that inspectors employed by municipalities, fire protection districts, and counties and those individuals who meet the certification requirements of the Fire Sprinkler Contractor Licensing Act may inspect such devices to ensure compliance with the Act. House Amendment No. 2 Provides that individuals licensed under the Professional Engineering Practice Act of 1989 may also inspect the life safety and fire protection devices. PRIVATE SEWAGE-LOCAL GOV REG

Amends the Private Sewage Disposal Licensing Act. Permits a unit of local government to require homeowners who maintain a private sewage disposal system within the unit of local government to provide verification, no more frequently than once every 3 years, to the unit of local government of a valid contract with a licensed private sewage disposal system installation contractor. Provides that no additional fee may be charged for such verification. Effective immediately.

INFO TECH-REPORT CHILD PORN Amends the Abused and Neglected Child Reporting Act. Provides that if an electronic and information technology equipment worker discovers any depiction of child pornography while installing, repairing, or otherwise servicing an item of electronic and information technology equipment, that worker shall immediately report the discovery to the local law enforcement agency. Provides that an electronic and information technology equipment worker who reports a discovery of child pornography as required under this provision is immune from any criminal, civil, or administrative liability in connection with making the report. Effective immediately. ALL KIDS-AUDIT-REPORT-PREMIUMS

Amends the Covering ALL KIDS Health Insurance Act. Requires the Department of Healthcare and Family Services to annually publish in newspapers around the State the premiums or other cost sharing requirements of the Covering ALL KIDS Health Insurance Program. Requires the Department to provide a copy of all contracts awarded for the administration of the Program to certain members of the General Assembly. Requires the Auditor General to perform an annual audit of the Program.

Governor Amendatory Veto Message
Recommends that the Department of Healthcare and Family Services annually publish electronically on a State website and in no less than 2 newspapers in the State (instead of just in newspapers around the State) the premiums or other cost sharing requirements of the Covering ALL KIDS Health Insurance Program.

INS CD - POLICY CANCELLATION Amends the Illinois Insurance Code. Provides that no company may cancel, terminate, or refuse to renew any policy of property and casualty insurance during the pendency of a claim in which the primary residence of the policyholder is or comes to be uninhabitable, unoccupied, or under construction or has yet to be permanently repaired. Provides that any of the following acts by an insurer shall constitute improper claims practice: (1) paying an appraiser, contractor, or vendor involved in providing services or estimates for appraising the value of any loss for repairing a policyholder's home; (2) compelling a policyholder as to which appraiser, vendor, or contractor the policyholder must use for the repair; (3) failing to reimburse a policyholder within 30 days after receiving proof of reimbursable out-of-pocket expenses; or (4) denying a policyholder's request for reimbursement without a written explanation within 30 days after a policyholder's request.[...]

HUMAN RTS, FAIRNESS IN LENDING Creates the Mortgage Steering Act. Prohibits mortgage loan steering or other specified fee and loan practices, based upon (i) the borrower's credit history, (ii) the borrower's capacity to repay the loan, and (iii) the property on which the loan is secured, because of that borrower’s race, gender, age, disability, or national origin. Provides that the Attorney General shall enforce the Act and grants the Attorney General the additional listed enforcement powers. Provides for injunctive relief, restitution, and civil penalties for violations of the Act. Provides that a person who suffers actual damages as a result of a violation of the Act by a lender may bring an action against that lender and may be awarded actual economic damages or any other relief that the court deems proper. Provides that any waiver or modification of the rights, provisions, or remedies of the Act shall be void and unenforceable. Senate Committee Amendment No. 1

ETHICS-STATE PROCUREMENTS

Prohibits the solicitation and making of campaign contributions by a business entity with annual aggregate contracts and bids with State agencies under the Governor in excess of $50,000, and by that business entity’s affiliates, on behalf of (i) a State executive branch constitutional officer, a General Assembly member, or a declared candidate for any of those offices and (ii) a political committee of a political party’s state central committee that is represented by a State executive branch constitutional officer or General Assembly member. Specifies the duration of the prohibition, means of enforcement, and penalties for violation, including termination of the procurement. Effective January 1, 2009 and applicable to procurements entered into on and after January 1, 2009.

ETHICS-STATE PROCUREMENTS

CRIM CD-IMPROP USE PUBLIC FUND Amends the Criminal Code of 1961. Creates the offense of improper use of public funds. Provides that a person commits the offense when he or she knowingly misappropriates, misuses, or unlawfully withholds or converts to his or her own use or to the use of another any public funds made available through a gubernatorial or legislative member initiative. Provides that an official or employee of the State or a unit of local government who knowingly facilitates, aids, abets, assists, or participates in the misappropriation, misuse, or unlawful withholding or conversion to his or her own use or to the use of another any public funds made available through a gubernatorial or legislative member initiative also commits the offense. Provides that a person convicted of a felony violation of improper use of public funds is ineligible to receive any grant or contract from the State of Illinois. Amends House Bill 5701 of the 95th General Assembly, if and only if that bill becomes law, by providing that no monies may be expended from any appropriation or reappropriation under specified Sections of Article 48 of that bill (instead of any Section of Article 48 of that bill) unless a grant or contractual agreement for the expenditure was agreed to in writing prior to August 31, 2007. UTILITIES-VILLAGE-WATERWORKS

Amends the Illinois Municipal Code. Provides that the Village of Woodridge may not acquire, construct, contract to construct, or maintain a waterworks or sewerage system outside of its corporate boundaries or planned boundaries without the approval by the Illinois Commerce Commission of a certificate of public convenience and necessity. Amends the Public Utilities Act. Provides that the Village of Woodridge shall not begin the construction of, or contract for the construction of, any waterworks or sewerage system outside of its corporate boundaries or planned boundaries unless and until it shall have obtained from the Commission a certificate that public convenience and necessity require such construction. Effective immediately.

DEBT PROTECTION AGREEMENTS

Amends the Credit Card Issuance Act and the Retail Installment Sales Act. Provides that, for a 3-day period, retail sellers may not solicit credit-card applicants or buyers in a retail installment transaction to enter into a debt protection agreement. Requires the retail sellers to make certain disclosures when soliciting for debt protection agreements after that 3-day period. Provides that the retail seller may not charge any debt-protection-agreement fees to a person's account, or otherwise charge or collect such fees, until that person has signed a separate contract providing all of the terms and conditions of the debt protection agreement. Includes retail sellers within the penalty provisions for violations of the Credit Card Issuance Act. Contains other provisions. Effective immediately.

IDOT CONSTRUCTION DELAYS

Amends the Illinois Procurement Code. Requires that each Department of Transportation construction contract specify a construction completion date and a monetary penalty against the contractor for each day completion is delayed for a cause attributable to the contractor or a subcontractor. Grants a business that suffers economic losses due to the delay the right to recover those losses from the contractor in the circuit court, up to the contract's penalty amount.
