Domestic Relations - Specifies that limitations on actions by creditors will not apply, and the creditors' claims will not be extinguished, if the transferor is indebted on account of an agreement, judgment, or order of court for the payment of one of the following: past due child support; past due alimony in solido of a spouse or former spouse; past due alimony or support of a spouse or former spouse; or a division of marital property of a spouse or former spouse. - Amends TCA Title 35, Chapter 16, Part 1. Companion Bill HB3031. Garnishments and Executions - Revises method for calculating amount of wages withheld in a garnishment. - Amends TCA Section 26-2-404(b). Fiscal Summary for *SB3156 / HB3031 Increase Local Govt. Expenditures* - Exceeds $50,000/One-Time Bill Summary for *SB3156 / HB3031 Under present law, there are two ways to calculate the amount of wages withheld in a garnishment depending upon whether the judgment is for child support or alimony or for some other debt. If the judgment is for a debt other than for alimony or child support and the garnishee does not earn more than $127.50 per week after social security and income tax withholdings, then no wages may be withheld. This bill switches the threshold for garnishing wages for debt other than for alimony or child support, and for alimony where the ex-spouse [...]
