Under present law, any person who knowingly causes damage to or the destruction of another person's property without the property owner's consent is guilty of the criminal offense "vandalism," which is valued and punished in the same manner as theft.

This bill creates a new criminal offense. Under this bill, any person who intentionally defaces another person's property with graffiti would commit a criminal offense that is valued and punished in the same manner as theft.

Fiscal Summary for *HB3792 / SB3967MINIMAL Bill Summary for *HB3792 / SB3967 Present law requires every person who holds property that is presumed abandoned and subject to custody as unclaimed property to notify the state treasurer. Not more than 120 days or less than 60 days before filing the report with the treasurer, the holder is required to send written notice to the apparent owner, informing such person that the holder is in possession of the property, if the holder has an address for the apparent owner which the holder's records do not disclose to be inaccurate and the property has a value of $50.00 or more.
