Fiscal Summary for SB4019 / *HB3846Increase Local Revenue - $112,500/Permissive/FY08-09 $225,000/Permissive/ FY09-10 and Succeeding Years Bill Summary for SB4019 / *HB3846 Present law authorizes Sullivan County to levy a litigation tax of $25.00, the proceeds of which must be used exclusively for the purposes of jail or workhouse construction, reconstruction, or upgrading, or to retire debt, including principal and interest and related expenses, on such construction, reconstruction, or upgrading or for courthouse renovation. Subject to local approval, this bill would authorize Sullivan County to use part or all of the proceeds of its litigation tax for courthouse security. ON APRIL 21, 2008, THE SENATE ADOPTED AMENDMENTS #1 AND #2 AND PASSED SENATE BILL 4019, AS AMENDED. AMENDMENT #1 changes the effective date of this bill from July 1, 2008, to upon becoming a law. AMENDMENT #2 subject to local approval, authorizes Rhea County to impose a litigation tax in the amount of $25.00, all or part of which may be used for courthouse security. ON MAY 1, 2008, THE HOUSE SUBSTITUTED SENATE BILL 4019 FOR HOUSE BILL 3846, ADOPTED AMENDMENTS #2, 3, 4, 5, 9, 10, 11, 12, AND 13, AND PASSED SENATE BILL 4019, AS AMENDED. AMENDMENT #2 adds Lauderdale County to the list of counties that are authorized by present law to levy a litigation tax of up to $25.00. AMENDMENT #3, subject to local approval, authorizes Williamson County to impose a litigation tax in the amount of $25.00, all or part of which may be used for courthouse security. AMENDMENT #4 adds Blount County to the list of counties that are authorized by present law to levy a litigation tax of up to $25.00. AMENDMENT #5 adds Sevier County to the list of counties authorized under present law to impose a $25.00 litigation tax. AMENDMENT #9, subject to local approval, authorizes Maury County to impose a litigation tax in the amount of $25.00, all or part of which may be used for courthouse security. AMENDMENT #10 adds Madison County to the list of counties authorized under present law to impose a $25.00 litigation tax. AMENDMENT #11, subject to local approval, authorizes Giles and Marshall counties to impose a litigation tax in the amount of $25.00, all or part of which may be used for courthouse security. AMENDMENT #12, subject to local approval, authorizes Hardeman County to impose a litigation tax in the amount of $25.00, all or part of which may be used for courthouse security.
