Fire Prevention and Investigation - Authorizes county mayor to appoint a fire marshal; if a county fire marshal is employed, the mayor must set the compensation within the amount appropriated for such purpose by the county legislative body; requires any county fire marshal to have at least five years experience as a firefighter, be certified by the state fire marshal as a fire safety or building inspector, and serve at the pleasure of the county mayor. - Amends TCA Title 5, Chapter 6 and Title 68, Chapter 102. Fiscal Summary for HB3867 / *SB3885Increase Local Expenditures* - Exceeds $2,964,500 Bill Summary for HB3867 / *SB3885 This bill requires the county mayor for each county to employ a county fire marshal to reduce fire deaths and injuries, investigate fires for cause and origin, enforce burning regulations, and investigate the environmental impact from illegal burning. The salary of each county fire marshal would be set by the county mayor within the amount appropriated for such purpose by the county legislative body. Each county fire marshal would be required to have at least five years' experience as a firefighter. A county fire marshal would serve at the pleasure of the county mayor. ON APRIL 21, 2008, THE HOUSE ADOPTED AMENDMENT #3 AND PASSED HOUSE BILL 3867, AS AMENDED. AMENDMENT #3 rewrites this bill to authorize each county mayor to appoint a fire marshal to coordinate the efforts of volunteer fire departments, enforce local fire safety regulations, and assist in the prevention of fire and arson. If a county fire marshal is employed, the county mayor will be required to set the county fire marshal's compensation within the amount appropriated for such purpose by the county legislative body. This amendment requires any county fire marshal to have at least five years experience as a firefighter, be certified by the state fire marshal as a fire safety or building inspector, and serve at the pleasure of the county mayor.
