Fiscal Summary for HB3712 / *SB3177 MINIMAL Bill Summary for HB3712 / *SB3177 Present law authorizes the filing of workers' compensation lawsuits in circuit or chancery court; however, present law authorizes circuit, chancery, and criminal courts to commute an award of workers' compensation periodic payments to one or more lump sum payments. In determining whether to commute an award to a lump sum, present law requires the trial court to consider whether the commutation will be in the best interest of the employee, and whether the employee can wisely manage and control the commuted award, regardless of whether special needs exist.
