Companion Bill SB3616. Abortion - Creates a private right of action for the parents of a minor, pregnant woman against a person who performs a partial-birth abortion on the woman. - Amends TCA Section 39-15-209. Fiscal Summary for HB3359 / *SB3616Increase State Revenue - Not Significant Increase State Expenditures - Not Significant Bill Summary for HB3359 / *SB3616 Under present law, it is a Class C felony for a person to perform a partial-birth abortion. This bill adds a private cause of action for a violation of the state's partial-birth abortion ban. Under this bill, if the woman upon whom a partial-birth abortion is performed is under the age of 18, then that woman's parents may, in a civil action, obtain relief for the violation of the partial-birth abortion ban.
