Fiscal Summary for HB3321 / *SB3469Increase State Expenditures - $56,400 Increase Local Expenditures - Not Significant Bill Summary for HB3321 / *SB3469 This bill requires that a justification report be filed with an LEA within 15 days after a student is suspended or expelled or is referred to juvenile court or another court having jurisdiction. This reporting requirement would apply to the principal, assistant principal, teacher-principal, director, or disciplinary hearing authority responsible for the decision to suspend or expel the student or refer the student to court. The justification report must provide the circumstances surrounding and the rationale for the suspension or expulsion and any statements taken from interested parties. The report must contain the following demographic information regarding the student: race, gender, age, grade level, and grade point average. This bill requires each LEA to forward the reports to the department of education. This bill requires the department to publish an annual report providing data extracted from the submitted demographic information and reporting trends, problems, and potential solutions revealed by the reports. The department would post the annual report on its Web site and submit it to the house and senate education committees, the children and family affairs committee of the house, and the senate general welfare, health and human resources committee. ON APRIL 28, 2008, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 3321, AS AMENDED. AMENDMENT #1 rewrites this bill to require the commissioner of education to report on a semi-annual basis to the select oversight committee on education and the education committees of each house of the general assembly regarding disciplinary actions in Tennessee schools. The reports must include the reason for the disciplinary action, the number of students suspended or expelled and the number of students placed in an alternative educational setting. This amendment also requires the data that is included in the report to be sorted by school and by various demographic factors including grade, race, and sex. Latest Actions
