Capital Punishment - Clarifies that intent of general assembly is to proceed with executions by any constitutional means if any state or federal court determines lethal injection or electrocution to be unconstitutional methods under the Tennessee or United States constitutions. - Amends TCA Title 40, Chapter 23. Fiscal Summary for SB3494 / *HB3087Other Fiscal Impact - Lethal injection and electrocution are the only forms of execution currently authorized by statute in Tennessee. If another form of execution were used as a result of this bill (e.g., gas chamber), there may be costs of developing and implementing the system, depending on the system used.
