Fiscal Summary for HB2086 / *SB0372MINIMAL Bill Summary for HB2086 / *SB0372 Present law requires a secured party that disposes of collateral to send to specified persons, including the debtor, a reasonable authenticated notification of disposition. Present law, however, does not state expressly whether notice of disposition that is not received by the intended recipient may be considered reasonable for these purposes. This bill specifies that a secured party will be considered to have complied with the notice provisions in a commercially reasonable manner if the record or notification is sent, regardless of whether or not such notice is actually received.
