Present law authorizes judges to allocate court costs to either or both parties in a civil lawsuit. This bill requires the courts to assign all reasonable costs of litigation, including court costs, investigatory costs, and attorneys' fees to the losing party in a lawsuit. In an action for negligence, the plaintiff would be considered the prevailing party if the plaintiff's negligence is adjudged as less than the defendant's negligence.
